Terms of Service

1. Agreement to Terms

By accessing or using the Giin platform at giin.ai or app.giin.ai, you agree to these Terms of Service. The platform is operated by Owens Enterprises LLC, a Wyoming limited liability company ("Giin", "we", "us"). If you do not agree, do not use the Service.

2. Eligibility

To use the Service you must:

• Be at least 18 years of age, or the local age of majority in your jurisdiction, whichever is higher.
• Have the legal capacity to enter into binding agreements.

By using the Service, you represent that you meet these requirements.

3. Accounts

• Patron accounts — created via phone number or email verification.
• Venue accounts (admin and staff) — invitation-based; access is granted by a venue administrator.
• Account security is your responsibility. Do not share your credentials.
• One account per person. Creating multiple accounts to circumvent restrictions is prohibited.

4. Acceptable Use

You agree not to:

• Commit fraud, abuse the rewards system, or impersonate another person or venue.
• Use automated scripts or bots to scrape the Service or complete tasks.
• Interfere with other users' access to the Service or with venue operations.
• Violate any applicable local, national, or international law or regulation.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Rewards and Coupons

Rewards earned through Giin tasks are issued by participating venues, not by Giin. Giin facilitates the issuance and redemption process. Reward terms — including validity periods and redemption conditions — are set by the issuing venue and snapshotted at the time the patron completes the task. Once earned, rewards are honored according to the terms in effect at the time of completion.

• Rewards have no cash value and cannot be exchanged for money.
• Rewards are non-transferable and may not be sold or gifted.
• Lost or expired rewards are not replaced.
• Giin is not responsible for a venue's failure to honor a reward.

6. SMS and Email Communications

SMS

• We send transactional verification codes only. We do not send marketing SMS.
• Message and data rates may apply.
• Reply STOP to any message to opt out of SMS communications.

Email

• We send account-related communications such as verification codes and important service notices.

7. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

• The Giin name, logo, and platform — including all software, design, and content created by Giin — are the property of Owens Enterprises LLC.
• User-generated content (such as custom task descriptions created by venues) remains the property of the user who created it. By submitting content to the Service, you grant Giin a limited license to display and process that content solely to operate the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or available at any particular time.
• Any specific reward will be available or honored at any specific venue.
• The Service will meet your specific expectations or requirements.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Owens Enterprises LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or USD $100, whichever is greater.

11. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the courts located in Wyoming, and you consent to personal jurisdiction in those courts.
